An understanding of the term ‘capacity’ and its scope in the context of the Mental Capacity Act is crucial for those involved in the Health, Social Care and the voluntary sector.

The Mental Capacity Act and Deprivation of Liberty Safeguards was implemented in April 2007. A wide range of people need to be aware of the requirements of the Act, including practitioners, managers and those with lead responsibilities in the statutory and voluntary sectors.

The Mental Capacity Act and Deprivation of Liberty Safeguards continues to have a major impact across the Health and Social Care sector as well as the voluntary sector. An awareness of case law developed since the implementation of the Act and the decisions of the Court of Protection is increasingly important.
