The Mental Capacity Act (MCA) was implemented in April 2007. Service Managers as well as those involved in commissioning training are aware of the need to develop training programmes to cover the needs of a variety of groups across the organisation. An understanding of the term ‘capacity’ and its scope will be crucial for those involved ranging from Mental Health Act Managers, managers, and individual practitioners.
The Mental Capacity Act will have a major impact across the Health and Social Care sector as practitioners find that they need to understand and work with capacity as defined by the Act as well as working for the best interests of the service user.
Care workers and support workers will also need to understand the key concepts within the Act to ensure that they act appropriately in the context of the care plan. An organisation wide awareness of the legislation will also be important in managing corporate and clinical risks.
Telos programs will have a particular focus on the impact of the Mental Capacity Act on particular care settings, for example residential and nursing homes, in-patient wards as well as community settings. Our programs will be geared to specific client groups, e.g. Older People with Mental Health Needs, as well as covering the interface of the Act with present and planned Mental Health legislation and the role of the Independent Mental Capacity Advocate (IMCA).
